General information clause on the processing of personal data

According to Art. 13 sec. 1 and sec. 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: “GDPR”) , we provide you with the following information on the use of the personal data obtained:

Purpose and legal basis for the processing of personal data:

3. Personal data will be processed only for the following purposes:

a) ensure the possibility of purchase/sale by the Administrator of services and/or goods [contact details of you and/or Representatives (natural persons representing a natural person or a legal person or another organizational unit) and data contained in submitted offers, as well as data made available to the Administrator for the purpose of negotiations preceding the conclusion of the contract, commercial talks before and during concluded and not concluded contracts] - (legal basis: the legitimate interest of the Administrator, in accordance with the provision of Article 6(1)(f) of the GDPR),
b) conclusion of contracts by you with the Administrator and their proper implementation, as well as in order to identify persons authorized to represent and incur liabilities and contacts with the Administrator - (legal basis: performance of the contract, in accordance with the provision of Article 6(1)(b) ) GDPR),
c) tax, insurance, reporting, payment processing, issuing and storing VAT invoices and other accounting documents for the period required by law, fulfilling obligations towards state and local government authorities imposed on the Administrator by law (legal basis: legal obligation in accordance with art. 6 section 1 point c) GDPR),
d) current activity of the Administrator, creating lists, analyzes and statistics for the needs of the Administrator related to the subject of his activity, considering complaints, reporting, conducting administration, archiving data, applications / correspondence in paper and electronic form (including scanned), ensuring security and protection property - (legal basis: the Administrator's legitimate interest, in accordance with the provision of Article 6(1)(f) of the GDPR),
e) determining and pursuing claims and defending against any claims related to the conclusion, non-conclusion and/or performance of contracts, debt collection, court proceedings - (legal basis: the Administrator's legitimate interest, in accordance with the provision of Article 6(1)(f) ) GDPR).

Types and categories of personal data processed:

The following types and categories of personal data provided voluntarily (or obtained from public registers) will be processed: identification data (including data of Representatives): name, surname, ID card series and number, PESEL number, image, tax identification number and status tax; address and contact details (including Representatives' details): place of residence, place of business, telephone (fax) number, e-mail address; banking and financial details: bank account number.

Sharing personal data with other entities:

Your personal data will be made available only to entities authorized to request access to personal data on the basis of legal provisions (including courts and control bodies of state and local government administration) and entities processing personal data on behalf of and at the request of the Administrator and on the basis of concluded civil law contracts, i.e. entities operating ICT systems or providing ICT tools, subcontractors or service providers supporting the Administrator in the implementation of contracts concluded with you (e.g. banks), agents and other intermediaries in the sale of products and/or services offered by the Administrator, entities providing postal and courier services, advisory, consulting, transport, accounting, tax, accounting and legal as well as debt collection services.

6. Your data will not be made available to a third country (outside the EEA) and/or an international organization.

Personal data storage period:

7. Your personal data will be stored until the completion of all factual and legal activities necessary to perform the contracts referred to in point 3 above and after their completion for the period necessary to establish and pursue claims and defend against any claims related to the conclusion, non-conclusion and/or performance of contracts and to the extent required by law for the period of performing accounting, accounting and tax obligations.

Rights of the person whose personal data is processed:

8. You have the right to:

a) access to the content of your personal data and obtain a copy of the processed personal data, on the terms set out in art. 15 GDPR,
b) rectification of personal data, on the terms set out in art. 16 GDPR,
c) demand the removal of personal data processed unjustifiably (the right to be forgotten), on the terms set out in art. 17 GDPR,
d) request the restriction of personal data processing, on the terms set out in art. 18 GDPR,
e) object to the processing of personal data on the terms set out in art. 21 GDPR.

9. In addition, you have the right to lodge a complaint with the President of the Office for Personal Data Protection, if you believe that the processing of your personal data violates the law.

Do you have to provide personal data?

Providing your personal data is voluntary, but necessary in order to make contact, place an order, conclude and properly implement contracts and commercial transactions, and meet the requirements of the law.

Automated way of processing personal data:

Your personal data will not be processed in an automated manner and will not be subject to profiling.
